No accident"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In the first post in this series [<em>\u201c<a href=\"https:\/\/imaginef1.shop\/2026\/03\/27\/unanswered-question-about-the-3-flat-rate-duty\/\">The \u20ac3 flat rate duty and the important unanswered question (pt.1)<\/a>\u201d<\/em>], we asked a simple question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What exactly is an \u201citem\u201d?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In the second [<em>\u201c<a href=\"https:\/\/imaginef1.shop\/2026\/04\/06\/flat-rate-duty-when-you-get-it-wrong\/\">The \u20ac3 flat rate duty (pt.II)<\/a>\u201d]<\/em>, we asked another simple question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What happens if you get it wrong?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Now we have something more useful than speculation: we have clarification from regulators (yes, we simply asked the Regulators and received some responses). However, as is often the case, the clarification answers the question&#8230; while simultaneously creating a more interesting one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(if you want to skip ahead and ruin the suspense, part IV (conclusion) is <a href=\"https:\/\/imaginef1.shop\/2026\/05\/31\/merchants-who-adapt-will-win\/\">here<\/a>).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h4 class=\"wp-block-heading\">The short version<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The \u20ac3 duty is not applied to the basket. It is applied to how the basket is <strong>declared<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Which means:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The same physical shipment of the same physical goods can produce different duty outcomes.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s unpack that properly.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What the regulators said<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Recent clarification from EU authorities provided a working definition of an \u201citem\u201d:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-631b61ddb61daaa284b543847f4c947f\"><strong>An item is one or more goods in a given consignment that share:<\/strong>\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-4e402c5483f63f3cebc0bc261803629c\">the same tariff classification<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-66db8169942f308b993c1e96295a8f91\">the same description<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-543031e7ea48c1e8739ab18948418035\">and (where relevant) the same origin<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">So far, so reasonable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then comes the part that matters:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c27a6a4b7ce9e4a3aeaae090efe8eeef\">If identical goods are declared on one declaration line -&gt; \u20ac3 is applied once<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-66beb66f57286450a0908d722fc7a61e\">If identical goods are declared on multiple declaration lines -&gt; \u20ac3 is applied multiple times<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And critically:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Customs systems treat each declaration line as a separate duty event<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Separately, national authorities have indicated that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-1acdc04be1b53e6bb720fc57e152d34c\">Classification depth may vary:\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-2fba692d80a0c61de8fa9e5ab6a6f5b8\">standard declarations -&gt; detailed tariff level (10 or 11 digit)<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-018cc223683323f1d93ffe247d975698\">simplified declarations -&gt; often 6-digit HS level<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-6a4111f1928f88c9d45d0d9d54cb8da3\">There is no confirmed harmonisation yet<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is the formal position.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Now translate that into the real world.<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">The official definition of \u201cper item\u201d is not what most people think<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Most merchants will instinctively assume:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">4 products = 4 items = \u20ac12<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is not how this works.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, 4 products can be 1 item, 2 items, 3 items or 4 items&#8230; depending on how they are declared. The word \u201citem\u201d sounds physical. It isn\u2019t. It is structural.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The declaration &#8211; not the basket &#8211; drives the outcome<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">This is where things get interesting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can have:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the same products<\/li>\n\n\n\n<li>the same quantities<\/li>\n\n\n\n<li>the same value<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And still end up with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>different duty outcomes<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Why?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the system doesn\u2019t charge based on what you sold. It is a direct consequence of how the system works.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If goods are grouped into a single declaration line<br>-&gt; \u20ac3 total<\/li>\n\n\n\n<li>If those same goods are split across multiple lines<br>-&gt; \u20ac3 per line<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Same shipment. Different structure. Different result.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Take a basket containing 4 excellent and highly recommended books about Product Innovation:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><a href=\"https:\/\/simonsinek.com\/books\/start-with-why\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;Start with Why&#8221; by Simon Sinek<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.elvinturner.com\/be-less-zombie\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;Be Less Zombie&#8221; by Elvin Turner<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/geoffreyamoore.com\/book\/zone-to-win\/\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;Zone to Win&#8221; by Geoffrey Moore<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.norulesrules.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;No rules rules&#8221; by Reed Hastings<\/a><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Assume they all cost \u20ac10.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If they are listed as 4 separate product lines on the customs declaration, the duty will be \u20ac12. In practice, it is about systems:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>eCommerce platforms<\/li>\n\n\n\n<li>middleware<\/li>\n\n\n\n<li>shipping providers<\/li>\n\n\n\n<li>customs brokers<\/li>\n\n\n\n<li>declaration engines<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Each of these can influence:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>how items are grouped<\/li>\n\n\n\n<li>how lines are created<\/li>\n\n\n\n<li>how data is structured<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Which means:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The duty outcome can be decided long before anyone consciously thinks about it <span style=\"text-decoration: underline;\">or<\/span> long after anyone has paid for it.<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">The uncomfortable bit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The regulation is trying to simplify low-value imports but what it actually introduces is a dependency on how goods are represented, not just what they are. That creates a new kind of inconsistency. Not legal inconsistency or classification inconsistency but <strong>structural inconsistency<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two valid declarations<br>-&gt; for the same goods<br>-&gt; can produce different results<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">This is not \u201cgaming the system\u201d<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to be clear about this. There is nothing &#8220;wrong&#8221; going on here. It&#8217;s exactly how the regulations are designed and published. Like us Product Managers(!), Regulators don&#8217;t worry too much about the &#8220;how&#8221; &#8211; their concern is the &#8220;what&#8221; and the &#8220;why&#8221;. As a result, nothing described here requires:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>manipulation<\/li>\n\n\n\n<li>optimisation tricks<\/li>\n\n\n\n<li>bad intent<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This happens simply because:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>systems structure data differently<\/li>\n\n\n\n<li>declarations are generated differently<\/li>\n\n\n\n<li>classification depth varies<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In other words:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Two merchants can get very different outcomes while both are doing everything \u201cby the book&#8221;<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Why this matters more than it looks<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">At \u20ac3, this may not seem like a big deal but the impact compounds:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>multi-line baskets<\/li>\n\n\n\n<li>high-volume merchants<\/li>\n\n\n\n<li>automated fulfilment flows<\/li>\n\n\n\n<li>VAT applied on top of duty<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Now multiply that across thousands of shipments. Or, to be more precise, billions of shipments (given that the whole reason for introducing this new rule is the 5.8 billion &#8211; and climbing &#8211; low value consignments shipped into the EU last year).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suddenly, this isn\u2019t about \u20ac3 anymore. It is about:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>margin erosion<\/li>\n\n\n\n<li>pricing accuracy<\/li>\n\n\n\n<li>customer trust<\/li>\n\n\n\n<li>audit defensibility<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">So where does this leave us (or you, the merchant)?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Back to the original question from Part I:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What is an \u201citem\u201d?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">We now have a better answer:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">An \u201citem\u201d is not what you sell<br>It is how you describe what you sell on a customs declaration<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And maybe you have no idea because you leave that to others&#8230;<\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Final thought<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you take one thing from this series, it should be this:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The problem is not the \u20ac3 charge<br>The problem is assuming it behaves in a simple, predictable way<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Because it doesn\u2019t and if you design your checkout, pricing, or fulfilment flows on that assumption, you are going to get surprised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If <a href=\"https:\/\/imaginef1.shop\/2026\/03\/27\/unanswered-question-about-the-3-flat-rate-duty\/\">Part I<\/a> was about the question, and <a href=\"https:\/\/imaginef1.shop\/2026\/04\/06\/flat-rate-duty-when-you-get-it-wrong\/\">Part II<\/a> was about the risk, then this is the reality:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Same basket. Different structure underneath.
